If one s action or omission is prohibited by criminal law,we can deduce he has mens rea without proving the realization on some element,though it is the element of harmfulness or leading to harmfulness.
严格责任应定义为:刑法规定的,只要行为人实施某一法定行为(或不作为),或处于法律规定的状态,无须证明行为人的主观心理中对行为某种要素(一般是行为的危害性或导致行为危害性的要素)的认识,而推定其具有犯意,如果行为人不能证明其主观无过错,则追究其刑事责任。
